Confidentiality
At The Active Counsellor, confidentiality is a fundamental part of ethical and professional counselling practice. All services are provided in accordance with recognised Australian counselling Codes of Ethics and Practice (including those set by professional counselling bodies such as the Australian Counselling Association (ACA) and PACFA).
Ethical Commitment to Confidentiality
All information shared during counselling including verbal disclosures, written records, assessments, and personal details — is treated as confidential and handled with respect, integrity, and professional care.
Information will not be disclosed to third parties without informed consent, except where ethical or legal obligations require otherwise.
Limits to Confidentiality
In line with ethical guidelines and Australian law, confidentiality may be breached when:
There is a serious and imminent risk of harm to the client or another person
There is reasonable suspicion of abuse or neglect involving a child, young person, or vulnerable person
Disclosure is required by law, including subpoenas or court orders
Information is necessary to prevent a serious threat to life, health, or safety
In such circumstances, only the minimum necessary information will be disclosed, and wherever possible, this will be discussed with the client first.
Children and Young People
When working with clients under the age of 18:
Confidentiality is upheld in a manner consistent with ethical practice and the client’s developmental capacity
Informed consent must be provided by a parent or legal guardian
Confidentiality boundaries are discussed clearly with both the young person and their parent/guardian
Information may be shared with parents/guardians when required by law or when there are concerns regarding safety or wellbeing
The Active Counsellor aims to balance the young person’s right to privacy with duty of care and legal responsibilities.
Record Keeping & Privacy
Client records are maintained securely and stored in accordance with privacy legislation and ethical standards. Access to records is restricted to the counsellor, except where lawful or ethically required.
Emergency Situations
The Active Counsellor is not a crisis or emergency service. In situations of immediate risk or danger, clients or carers should contact 000 or attend the nearest emergency department.
